8. File #2641 - Application for Nextel Communications of the Mid-Atlantic, Inc. to install cellular antennas and an equipment shelter on an existing US Cellular tower located at 19 Proctor Hill Road. Map 52 Lot 18. ACCEPTANCE OF APPLICATION & PUBLIC HEARING.
David Hodder and George Chianis appeared on behalf of Nextel. Plans are to install 12 panel antennas at a height of 130' on the existing 170' tower located at 19 Proctor Hill Road. There will also be a small equipment shed. The antennas are 6' long x 6.5" wide and weigh 15 lbs each. This plan will be going to the HDC for review this week.
C.Hoffman moved to accept File #2641 for consideration. Motion seconded by D. Gagne and unanimously approved. Public Hearing. Paul Levesque stated that the tower has devalued his property, and he opposes any change. He questioned why this is not going to the ZBA since it is non-conforming and a major change. He questioned why the applicant is not co-locating on the Birch Hill tower. He also questioned if US Cellular ever got a conditional use permit. The chairman responded that the Planning Board reviewed and approved a conditional use permit for US Cellular (in May 2003).
Mr. Chianis noted that the tower and antennas are painted galvanized gray; the Nextel antennas will be painted non-reflective gray. Mr. Chianis noted that Nextel is mandated by its FCC license requirements to do a build-out. The need for additional towers is minimized by collocation, and collocation is required by the Hollis zoning ordinance. The twelve panel antennas will not devalue Mr. Levesque's property. In addition to the panel antennas there are two GPS antennas, which are part of this proposal - one for telling the time when a cell phone is being used and the other for E911 coverage. The equipment shelter will be almost identical to the existing shed for US Cellular. Mr. Chianis reiterated that the Hollis ordinance directs the applicant to collocate on an existing tower. In answer to a question from D. Petry, Mr. Chianis explained that this site was selected due to topography, computer studies and location. This site will provide the best possible coverage at the 130' elevation. Birch Hill could not provide this same coverage. This site serves the area that Nextel wants and needs to cover. C. Hoffman moved to require the new antennas to be painted the same color as the existing antennas. Motion seconded by D. Gagne and unanimously approved.
C. Hoffman moved to approve File #2641, subject to the following conditions:
· The applicant shall obtain approval from the Historic District Commission
· The conditional use permit must be renewed if the additional antennas are to remain past November 2, 2009
· The antenna array to be painted the same color as the existing antennas.
The motion was seconded by D. Gagne and received unanimous approval.
